Terms of Service

These Terms are an agreement between you and Steppagotchi, operated by [LEGAL ENTITY TBD] ("Steppagotchi", "we", "us"). By using the Steppagotchi app you agree to these Terms and our Privacy Policy.

1. Who can use Steppagotchi

Steppagotchi is available in the United States only. You must be at least 13 years old. If you are under 18, you need a parent's or guardian's permission to use the app and to make purchases.

2. Your account

Keep your account secure and do not share it. If you are under 18, your parent or guardian must agree to these Terms for you. You are responsible for activity on your account. We may suspend or close accounts that break these Terms. You can delete your account anytime in Settings, Account, Delete account.

3. Steppagotchi Pro

Steppagotchi Pro is an auto-renewing subscription sold through Apple in-app purchase for $3.99 a month or $29.99 a year (US prices). The yearly plan includes a 7-day free trial for eligible new subscribers; the monthly plan has no trial. Payment is charged to your Apple Account when you confirm (or when the trial ends). The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your iPhone Settings, [your name], Subscriptions. Pro features and usage limits are listed in the app and may change. Pro does not include any feature that has not launched yet.

Pro items. Skins you get with Pro stay yours while your account exists, even if Pro ends. Other Pro features stop when Pro ends.

4. Virtual Currency and Items

Steppagotchi offers an in-app currency called Leaves and virtual items such as outfits and accessories. You can earn Leaves by walking or buy them through Apple in-app purchase: 2,200 Leaves for $4.99 or 4,400 Leaves for $9.99.

  1. Licence, not property. Leaves and virtual items are a limited, personal, non-transferable, revocable licence to use them in Steppagotchi. They are not property and you do not own them.
  2. No cash value. Leaves and items have no cash value and cannot be exchanged for money or anything of value outside Steppagotchi. You cannot cash them out, sell them, or transfer them to another account or to anyone outside the app. If we later offer in-app trading, only items marked tradable and Earned Leaves may be traded, only inside Steppagotchi and under the trading rules we publish then. Buying, selling or trading Leaves, items or accounts for real money or outside the app is not allowed, and we may remove items or close accounts involved.
  3. Payment and refunds. Apple processes all purchases. Purchases are final and non-refundable, except as required by law or under Apple's refund policies (reportaproblem.apple.com). If Apple refunds a purchase, we may remove those Leaves or items, or, if they are spent, limit purchases until the amount is restored.
  4. No expiry. Leaves do not expire.
  5. Earned and Bought Leaves. We track Earned Leaves and Bought Leaves separately. By default, we spend Bought Leaves first; you can change this in your Wallet. Items bought in whole or in part with Bought Leaves are marked non-tradable.
  6. Prices and changes. We may change the Leaves price of items, the items on sale and pack contents. We will not reduce Leaves you already have, except to correct an error or reverse a refunded or fraudulent purchase.
  7. Minors. If you are under 18, you need a parent's or guardian's permission to buy Leaves, items or Pro. Users aged 13 to 17 are limited to $20 a month in total in-app purchases. Parents can also manage purchases with Apple's Ask to Buy and Screen Time.
  8. Account closure. If you delete your account, your Leaves and items are deleted and cannot be restored; we will warn you about any unused Bought Leaves before deletion. If we close your account for a serious breach of these Terms, you may lose unused Leaves and items. If we shut down Steppagotchi, we will give at least 60 days' notice and stop selling Leaves at least 30 days before.

Streak shields and revives. A shield covers one missed day of your personal streak. A revive restores your streak count and streak bonuses after a break if used within 48 hours; it does not restore Leaves or rewards from missed days. You can buy up to 2 shields a month and hold up to 3 at a time. Shields and revives never affect challenges, prizes or leaderboards.

5. Challenges

Challenges in Steppagotchi are free and have no prizes of monetary value.

6. Health and wellness

Steppagotchi is not a medical device or a crisis service. It gives general walking tips, not medical advice. Check with a doctor before changing your exercise, especially if you have a health condition. If you are struggling or thinking about hurting yourself, call or text 988.

Some optional features use AI. AI-generated content is labelled and may be inaccurate. See our AI disclosure and Privacy Policy.

8. Acceptable use

Do not cheat, misuse the app, harass others, try to get around purchase limits, or break the law. In particular, you may not:

9. Apple App Store terms

These terms apply because you got Steppagotchi from Apple's App Store:

  1. Parties. These Terms are between you and Steppagotchi only, not Apple. Steppagotchi, not Apple, is solely responsible for the app and its content.
  2. Scope of licence. We grant you a limited, non-transferable licence to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions (except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing).
  3. Maintenance and support. We alone are responsible for any maintenance and support of the app. Apple has no obligation whatsoever to provide any maintenance or support services for the app.
  4. Warranty. We are responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility, not Apple's.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the app's use of HealthKit.
  6. Intellectual property claims. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints or claims about the app: Steppagotchi, [LEGAL ENTITY TBD], [ADDRESS TBD], support@steppagotchi.com.
  9. Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

10. Disclaimers and limitation of liability

Steppagotchi is provided "as is" and "as available" to the extent permitted by law. To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability to you for all claims relating to Steppagotchi is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) $50.

These limits do not apply to liability for our gross negligence, fraud, or death or personal injury caused by us, or to any liability that cannot be limited or excluded by law. Some states do not allow these exclusions, so they may not apply to you.

11. Governing law

These Terms are governed by the laws of [STATE TBD], United States, except where your local law gives you other rights. To the extent permitted by law, any dispute relating to these Terms or Steppagotchi must be brought exclusively in the state or federal courts located in [STATE TBD], except that either of us may bring an individual claim in small-claims court where it qualifies.

To the extent permitted by law, you and we each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, consolidated or representative action, and each waive any right to a jury trial.

12. Changes

We may update these Terms. For material changes, we will tell you in the app or by email at least 30 days before they take effect. If you do not agree, you can stop using Steppagotchi and delete your account. Changes do not apply to disputes that arose before they took effect.
